In 2012, Virginia became the first state to allow for the authorization of a remote signer with an electronic notary using audio-visual conferencing technology to attest to the identity.

While this was a landmark move, it really didn’t change much about how the notarization process works – as you’ll learn here.

A notary public plays an essential role in acknowledging signatures on important documents, and you’ll very likely need the services of one at some point in your life.

As an impartial witness, their primary duty is to mitigate fraudulent documentation. But to do so, they public must follow the rules as set out by the state they’re commissioned in.

With that in mind, here’s a quick look at what Virginia notary publics do:

Notary Agent’s Duties

Virginia Mobile Notaries

A Virginia notary public can notarize signatures, administer oaths, and certify copies. They must commence these duties impartially, and are restricted from engaging in situations where they are personally involved.

Notaries are also required to verify the identity of the signees using a government-issued identification card such as a driver’s license or passport.

Some popular reasons that citizens need the help of a notary are for real estate documents, wills, affidavits, or a power of attorney.

In Virginia, the Governor can appoint a notary public. These notaries public are commissioned by the Secretary of the Commonwealth, provided the candidate meets the following qualifications to become a notary public in Virginia:

  • They must be 18 years of age
  • Also must be a legal resident of the U.S.
  • Can read and write English
  • They cannot be convicted of any felonies that have not been pardoned or vacated

It’s also possible for a non-resident of Virginia may become a notary public there if they are employed in the state. An application must be completed and approved.

You should also know that a seal is required for all notary public acknowledgments in Virginia, which should be sharp, legible, permanent, and photographically reproducible.

The registration number of the notary public must also appear on the document.
