As public servants, notary publics  must commit to upholding high standards of integrity and honesty. They must also fulfill the following requirements in order to obtain and keep their position:

  • The notary public must reside in New Mexico.
  • The notary must be fluent in reading and writing English.
  • A notary public in New Mexico cannot have a guilty plea to or a conviction of a felony, or have pled nolo contendere.
  • The person must be at least 18 years of age.
  • The notary must not have any revocations of their notary license in the last five years.
  • The person who wishes to apply to be a notary public in New Mexico must do so with the Secretary of State.
  • In order to be considered for a notary public position, two character witness statements from New Mexico residents must accompany the application.

As a notary of New Mexico executes their duties, he or she must provide a method of signing the documents in question.

They must show that they witnessed the signing of the document(s). States have different requirements as to what type of method is sufficient proof of the notary’s signature.

Some states allow just the signature to suffice. However, New Mexico states that the notary must use either an ink stamp or embosser seal.
